Partner, Jeffrey DeGeorges secured a Summary Judgement win on behalf of a physician client. The New York County Supreme Court granted summary judgment in favor of our client, a facial plastic surgeon, in a case concerning the performance of a facelift and revision rhinoplasty. The plaintiff had claimed a lack of informed consent, negligence in the performance of surgery, as well as negligence in the post-operative care. As to damages, the plaintiff had claimed injury to the facial and hypoglossal nerves, purportedly resulting in facial asymmetry, deformity, and difficulties eating and speaking. The defense presented expert affirmations in the fields of plastic surgery and neurology, arguing that there had been no departures from accepted standards of care and that the alleged injuries were not related to the surgery. The defense further argued that the plaintiff’s alleged injuries were a result of unrelated conditions. The Court granted the defendant’s motion, finding that informed consent was proper, there had been no departures from accepted standards of care, and that the surgery had not caused the alleged injuries.
