BBO&C Partner Brian Connor recently secured a summary judgment dismissal on behalf of his clients, a property manager and a property owner, in New York State Supreme Court, Nassau County. Plaintiff alleged that defendants’ negligence caused him to slip and fall on ice resulting in a torn tendon in the shoulder, torn bicep tendon, and torn labrum resulting in arthroscopic surgery. Defendants established that there was a storm in progress when the plaintiff allegedly slipped and fell and Hon. Randy Sue Marber, J.S.C. granted defendants’ motion for summary judgment in its entirety. Plaintiff moved to re-argue the court’s decision and the Court denied plaintiff’s motion in June 2025 reiterating that defendants established that their efforts to remove snow and ice from the parking lot during the storm did not create a hazardous condition or exacerbate the natural hazard created by the storm.
