BBO&C Partner Brian Connor and Associate Alexandra Genovese recently secured a summary judgment dismissal on behalf of their clients, a shopping center and a store, in New York State Supreme Court, Richmond County. Plaintiff alleged that defendants’ negligence caused her to trip and fall resulting in an elbow fracture, shoulder tear, abrasions, and lacerations. Defendants established an open and obvious, easily avoidable, and not inherently dangerous condition. Hon. Catherine M. DiDomenico issued a decision in June 2025 indicating that defendants were entitled to summary judgment and plaintiff’s case was dismissed with prejudice.
