Discontinuance with Prejudice During Trial in New York County

BBO&C Partner Jeffrey DeGeorges recently obtained a discontinuance with prejudice during trial before Justice Kathy King in New York State Supreme Court, New York County in July 2025 as to our client, a Cardiothoracic Surgeon, who had consulted on a patient brought into the Emergency Room following complication of surgical resection of esophageal cancer at another hospital. Plaintiff alleged that our client failed to diagnose and treat an anastomotic leak and our client’s recommendations resulted in three years of pain and suffering in the patient, a then 56-year-old, married father of two. After three weeks of trial, and the day after our client testified in exemplary fashion, the plaintiff discontinued the case with prejudice without any payment on behalf of our client.
