BBOC Partner, Joseph Bisch, Esq., obtained a directed verdict before the Hon. James F. Quinn in Supreme Court, Suffolk County on December 13, 2024, in the case of Estate of Tepperman v. SCSMC, et al. The action concerned a 76-year-old female, who presented to the SCSMC emergency department with complaints of abdominal pain. The plaintiff alleged medical malpractice and wrongful death associated with the administration of three doses of two narcotics, which had been ordered by the emergency department physician. JSC Quinn granted defense motions pursuant to CPLR 4401, which argued that the plaintiff’s counsel had failed to make out a prima facie case.
