We are proud to announce that on November 18, 2024, senior associate, Nicole D. Fogarty, Esq., obtained a defense verdict in the Supreme Court, Kings County before the Honorable Gina Levy Abadi on behalf of our clients, an automotive repair company, in a trip/fall accident. It was alleged that the Plaintiff fell while attempting to exit our client’s tow truck sustaining serious injuries to his wrist and knee requiring surgery. Plaintiff claimed that the step of the tow truck was damaged, in that it was wobbly, thereby precipitating the fall and subsequent injuries. Nicole argued, in defense of the client, that the step was not wobbly, defective, or dangerous and that Plaintiff caused his own accident. After a 5-day trial, the jury returned a unanimous verdict for the Defendant. Congratulations Nicole on a job well done!
